Terms and Conditions (T&C)

 

As with all kinds of business there must be some ground rules to go back to, should there ever be a disagreement, and the words below are mine.

My first advice is, if you have a problem, please tell me. I do not bite, and all I want is for you to enjoy the learning experience so much, that you want to tell all your friends and family about it.

The following terms and conditions & code of practice represent the basis upon which driving lessons and courses are offered to you by James Wiseman advertised as "Learn2Pass".

General: - To run my business I can only look after a certain number of students at any one time, which means I may have to decline business from new students to look after those already on my books. So regular cancellations by a student will result in the student not receiving first choice on available lesson times or losing their set time slot. See paragraph d below for full information.

a.     Time allocation: - Time slots are booked as required by the student, the minimum time slot will be a 1 hour lesson. When first arranging a start date, we will have looked at all options available to the student and if a permanent time slot is allocated then you will not lose that time slot unless you brake the rule above

b.     Payments please note: - I do ask that payment must be made in advance of any lesson starting or “once in the car”. I do ask that payment for discounted block bookings are paid in full before the first lesson of the block booking starts. Payments can be made by Cash, Cheque or bank transfer. The cost of lessons can be found under bookings/prices on the main menu. Prices are subject to change at any time however notice will be given to the learner before the changes are made to them.

c.     Refunds and guarantee's: - In the event you pass your driving test with me and have unused tuition time, the money owed to you will be calculated at the reduced lesson hourly rate and refunded in full if a block booking was purchased, see example 1. Or in the event that a pre-pay deal is not completed before you pass your driving test or decide to quit training with me, any unused training time will be re-calculated at the normal lesson hourly rate and the balance refunded to you see example 2. (Note: cancelled lessons not previously charged for will be taken into account before the refund is made) 

·         Example: 1 “test passed” - You purchase a block of 10 hours driving tuition, at the discounted price of £235 which = £23.50 per hour, Normal full price for 10 hours is £300 which = £30 per hour. You pass your driving test and have 6 hours training unused, 6 hours at £23.50 per hour is £141. There for Refund = £141 full amount paid no lose to you.

·         Example: 2 “stopped learning” - you purchase a block of 10 hours driving tuition, at the discounted price of £235 which = £23.50 per hour, Normal full price for 10 hours is £300 which = £30 per hour. You decide to cancel your training with myself after having 4 hours training from your 10 hours blocked booking leaving 6 hours training unused. As you have not completed the deal the 4 hour lessons will be charged at the full rate. So 4 hours training at full price is £30 x 4 = £120, deducted from the discounted price paid of £235 = £115. There for Refund = £115

Note: prices are examples only, ask for up to date price. Prices are subject to change, however at the time of purchase you prices will be correct. Any changes after this will not affect what you have paid.

d.    Lesson Postponement or Cancellation – 24 hours’ notice of a cancellation is required to avoid a 100% lesson fee however, if I can easily obtain additional work for any individual lessons cancelled, I do not ask for payment. If it’s not possible to rebook the time set aside for your lesson I do ask you pay for your lesson. I do reserve the right to postpone lessons if I consider the weather or road conditions are unsuitable or dangerous. Also if the tuition vehicle becomes faulty, as I have no control of when this may happen. I cannot be held responsible for any costs incurred as a result of having to postpone any lessons, for whatever reason.  I earn my living, selling my time. When I enter into a contract to provide your training I have to plan my working week to sell enough hours to earn my living. Lost hours is a direct loss of income. So by booking a student into a time slot, I have removed that available slot from my diary, this stopping other students from picking that time.

e.       Punctuality - In their own interest learners are advised to be punctual for lesson appointments. I would normally wait for a maximum of 15 minutes before the full lesson would be abandoned and the lesson fee forfeited or become due for payment. If a lesson is started late by the learner the time may have to still start at the original time so I am able to get to my next student.  A reciprocal waiting time may become necessary if I am delayed due to unforeseen circumstances. Any lesson time lost as a result of this would be made up by me either at the end of the normal lesson time if possible or at a later date. 

f.    Learner Comfort and Safety: - In the interests of comfort and safety, learners are advised to wear suitable footwear and clothing which does not restrict movement. Learners must also take note of any medication they are taking that may affect their ability to drive safely and inform their instructor accordingly before taking any lesson booked. You must turn up to your driving lessons and test fit to drive. This includes the following:

 

a.      With ZERO alcohol in your system

b.       With ZERO drugs in your system, this including prescribed drugs that effect your ability to drive (seek doctors’ advice or read the leaflet              supplied)

c.      No injuries that stop you using all the vehicle controls correctly

d.      You must wear your glasses or contact lenses if required to read a number plate at, 20.5m Old style and 20m new style (Your           eye sight will be checked  on your first lesson and again, if doubt of your sight arises)

e.      You must have a valid provisional or full driving licence to drive on any public highway. 

 

g.     The Driving Test

·         Driving tests can be booked either by yourself or by me, if you are to book your test then this should be done after you have checked my availability. If you would like me to book your driving test then the correct fee is payable before this happens.

·         Driving test bookings always take priority over other lessons. Therefore, your lesson may be postponed to allow for someone else's driving test and vice-versa. Changes to lesson bookings as a result of this will be notified immediately minimum of 24 hours.

·         Once we have agreed a day and time and you have booked your test, you are required to notify me immediately, as my future lessons have to be booked around it; if sufficient notice is not given the availability of a vehicle for the test cannot be guaranteed. This issue is eliminated if we book the test together.

·         The Use of the vehicle for test: - In the interests of customer and public safety, I reserve the right to withhold the use of my car for the test if, in my opinion your driving is actually or potentially dangerous, in most situations this will be determined by at least the lesson before the cancellation date. This is to allow you to rearrange your test date and not lose your payment to the DVSA. Or you have not paid the correct fee for the use of the car on the test day. If the tuition vehicle becomes faulty and the test is unable to go ahead due to this and the test cannot be changed due to short notice and the fee is not able to be refunded then I will pay for the new test. Any lessons required to fill the gap between old and new test will not be paid me myself.

·         Test cancellation: - The DVSA requires three clear working days’ notice of cancellation or postponement of your test. This date will be shown on your booking conformation email.  Failure to provide the required notice will result in the loss of your test fee. I cannot be held responsible for any postponement or cancellation of tests by you or the DVSA for any reason. This also includes any extra training required whilst your new test date is approaching.

h.     Driving License and Eyesight – The learner must hold a current, valid driving licence (provisional or full), which must be produced on or in advance of their first lesson. The learner must also check that they can read a number plate at a distance of 20.5 metres (i.e. 67 feet - about 5 car lengths) on an old number plate and 20 meters on a new number plate. With glasses or contacts if normally worn. If required to read the number plate then they must be warn to drive. From June 2015 a driver (learner or licensed) must at the instructors request provide the necessary code to allow access to their driving record. If this is required I will explain how this is to be completed.

i.    Course Materials - I do recommend that students purchase the up to date Highway Code book. I have a training logbook book that you can purchase direct from myself that allows you to record all your training. It is the responsibility of the student or purchaser to make sure they consider the materials useful and appropriate, this logbook is not compulsory for your training. 

j.    Your statutory rights - These terms and conditions will not reduce your statutory rights relating to faulty or incorrectly described goods or services provided. If you have any doubts about your statutory rights please contact your local Trading Standards Department or Citizen's Advice Bureau.

Summary: - If you have any questions just ask then you will fully understand.
